Terms & Conditions

Lava.mt (the “Website”) is operated by Sloane Ltd, a company registered in Malta, holding company registration number C 7727 and having its registered address at Zachary House, Marsa Industrial Estate, Marsa, Malta (the “Company”, “us”, “we”).

These Terms & Conditions (the “Terms”) set out the terms and conditions under which the Company operates the Website. You may choose to visit the Website without registering for an account. Should you wish to make an order, you may: checkout as a guest user, register a new account with Lava.mt or you may also log in using your existing Lava Rewards credentials. These Terms will regulate our relationship with you as a visitor of the Website or as a registered member of the Website (“Member”). By visiting or using the Website, you accept to be bound by these Terms which are subject to changes at any time. We reserve the right to verify the individual’s eligibility to Lava.mt and may refuse registration or terminate your account if we have a justified reason to do so.

The individual must be at least 16 years old to register for a Lava.mt account (“Account”). The individual is responsible for age self-certification and giving incorrect information may lead to the termination of your Account. 

The Vendor shall solely be responsible for any warranties, returns and claims.

 

Accessing your Lava account

  1. Logging in by using your Lava Rewards credentials

  2. Creating a new Lava.mt Account which is free. A Lava Rewards account will automatically also be created to allow customers to benefit from earning points on any purchases made on Lava.mt.

The Member is responsible to update any personal information if changes arise. The Member is also responsible to maintain the confidentiality of their Account and password. The Company will not be liable for any unlawful or misuse of the Member’s Account.

You agree to notify us immediately of any breach of your log-in information. If you have any reason to believe that your account information has been compromised or that your account has been accessed by a third party, you agree to immediately notify the Company by e-mail to info@lava.mt.


Placing an order on Lava.mt

When placing an order on our Website, a valid payment method will be required to conclude the order.

An e-mail will be sent to your chosen email address which was listed in the registration form, confirming receipt of your order and order reference number. The e-mail received does not confirm that the order has been processed by our Vendors. Personal Data such as name, surname, address, mobile and email address shall be shared with the Vendors in order to be able to process the order/s and deliver your purchases. The order will be concluded when the Vendor has delivered the items and issued the invoice.

If the order includes items from multiple Vendors, sub-order reference numbers will be listed in the order confirmation e-mail. You will receive separate packages if your overall order contains products from multiple Vendors. For larger items purchased, the Member will be contacted prior to the delivery being made.

 

Earning & Redeeming Lava Rewards points

The Member can collect and redeem Lava Rewards points on any purchases made on the Website, as set out in the Lava Rewards Terms & Conditions found here: https://www.lavarewards.com.mt/terms.

The Member will receive a 2 Factor Authentication SMS upon logging in/signing up as a Member of the Website for the first time. If the Member does not finalise this step, redemption of points for any online purchases on the Website will not be permitted. If the Member changes any personal details including the email address or mobile number, this requirement will be triggered off again upon the next log in

The Member needs to be logged into the Lava.mt account using their Lava Rewards credentials to automatically benefit from obtaining the points or having access to the available balance of points to redeem. If this is not done, customers have a period of 30 days to claim points on the online purchases made.

Payments & Billing 

All prices on the Website are inclusive of VAT. Lava Rewards points earned on your purchases will be gained on the full amount, inclusive of VAT. Delivery fees incurred will also be awarded Lava Rewards points.


Failed Payments/Transactions

In the scenario of an incomplete order due to payment issues or technical issues on the Website, the Member will be contacted by a member of our team in order to settle the issue and finalise the order for the Member.


Refunds

In the unlikely scenario of a refund required for an out-of-stock item further to the order being placed by the Member, this will be done within a period of 7 working days. A full refund on the credit/debit card originally used for payment will be done.

In the case where Lava Rewards points were redeemed to purchase the item, a refund on points redeemed will take place, and any net amount pending refunded into the credit/debit card.


Returns

If a Member would like to return an item purchased on the Website, this will need to be done physically at the premises of the respective Vendor from which the item was purchased from. Returns policies will reflect the terms of each respective Vendor, however for the avoidance of doubt, the Member must clearly inform the Vendor of their intention to return a purchased item within a 14 day-period (the “Withdrawal Period”) from when the Member acquires physical possession of all the goods purchased.

Items may be returned as long as they are unused and in the same condition as they are received. Notwithstanding the above, items cannot be returned if you have started to assemble them, if they were made to measure or personalised, or if they are unsealed items which are deemed not suitable for return due to health protection or hygiene reasons such as but not limited to pillows, underwear, toilet seats, linen, towels, shower seats and personal care items.

The Member is to return the goods purchased to the Vendor by no later than 14 days from the day when they clearly informed the Vendor of their intention to return their purchase.

The Vendor aims to issue a refund, within 14 days from when the Vendor receives the returned item/s.


Deliveries

We strive to achieve deliveries within the following working day for small order items. Deliveries will be made individually by every Vendor. Below is a list of delivery policies per Vendor:


Inspirations Limited – Atrium:

  • Malta: Free delivery on all orders €50 and over. A charge of €10 is applicable for orders less than €50. The Atrium aims to deliver your items the next working day for orders made between Monday to Friday (excluding public holidays). Delivery for larger items such as sofas, BBQs, furniture etc. will take approximately 5 to 10 working days. The Atrium team will contact you directly with a proposed delivery date;
  • Gozo: All orders are subject to an additional €20 delivery charge. Deliveries to take 5 to 10 working days.

 

Homemate Company Limited – Homemate:

  • Malta: Free delivery on all orders €50 and over. A charge of €10 is applicable for orders less than €50. Homemate aims to deliver your items the next working day for orders made between Monday to Friday (excluding public holidays). Larger items such as sofas, gas BBQs, furniture etc. will take approximately 3 to 4 working days. The Homemate team will contact you directly with a proposed delivery date;
  • Gozo: All orders are subject to an additional €20 delivery charge. Deliveries are every Saturday. The order must be received by Wednesday to be included in the deliveries of the upcoming Saturday.  

 

Intercomp Marketing Limited – Intercomp:

  • Malta & Gozo: Free delivery on all orders €30 and over. A charge of €3.95 is applicable for orders less than €30. Intercomp aims to deliver your items within 2 to 3 working days between Monday to Friday (excluding public holidays). The Intercomp team will contact you directly with a proposed delivery date.

 

Once dispatched, delivery will be made solely to the address specified during the order. Any subsequent redirection requests are chargeable. If you are not available for the delivery, we will contact you to establish another delivery appointment. Extra charges may apply for the 2nd delivery attempt.

The delivery will require a signature from someone at the address specified. This is strictly enforced for security purposes.

 

The invoice provided by the Vendor delivering the items should be retained as proof of the warranty for the items purchased. The Company does not provide any warranties on products purchased from the Website. Kindly refer any questions regarding legal guarantees and commercial warranties to the respective Vendor. 

Deliveries of Heavy Furniture

All deliveries are made to ground floor. If you require goods to be taken up to the upper floors a furniture-lifter will be required. Should this be the case, our Vendorswill be more than pleased to make arrangements on your behalf with a trustworthy subcontractor at an extra charge. When a furniture-lifter is required, you will need to make arrangements with your Local Council for the issuing of a permit.

 

Click & Collect

We also provide the option to click & collect your order from any of our store locations. The Vendors will email you when your order is ready for collection, within a maximum of 24 hours from time of order. 

Promotional Codes

The Website may offer promotional codes with varying features and rates. Any such promotional code is valid until its stated expiration date.


Deleting your account

A Member can delete their Account while logged in to the Website from the ‘My Account> Account Details’ page. After deleting your account, all your personal data provided to us will be pseudonymised and retained by us for as long as necessary, as specified in the ‘How long will we keep your Personal Data?’ section in our Privacy Policy.

Your Lava Rewards account will not automatically be deleted when deleting your Account from our Website. You may cancel your Lava Rewards membership at any time by sending us an email to info@lavarewards.com.mt or by unsubscribing through the App following these steps: Menu > Profile > Deactivate Account. If a Lava Rewards account is closed, the Member’s rights to redeem points from that Lava Rewards account are lost and cannot be reclaimed.

 

Content Ownership

The Company or its Vendors own or have rights to all of the content we make available through the Website, such as text, logos, graphics, icons, images, software, audio, video, information or other materials (the “Content”). You cannot use our content without our written permission.

All Content and the compilation (meaning the collection, arrangement, and assembly) of all Content are protected under copyright, trademark, and other intellectual property laws and/or licensed to the Company or its Vendors.

Disclaimer

Although the Company strives to provide content, information, and related materials that are both useful and accurate, the nature of the data and other information available via the Website is subject to change. Accordingly, the content, information, and related materials available via the Website may not be up-to-date, accurate, or complete at all times.

Furthermore, while the Company will endeavour to ensure that the products, offers, benefits and arrangements as expressed or advertised by the Company and the Vendors will be available to the Members, the Company will not be liable for any loss or damage, whether direct or indirect, arising from the availability, non-availability, provision or non-provision, whether in whole or in part, of any such products, offers, benefits or arrangements.

 

Deposit Schemes, Easy Payment Scheme & Flexi Pay

Deposit schemes, the Easy Payment Scheme and Flexi Pay are not currently available through the Website. If the Member would like to benefit from these schemes, the order would need to be placed directly via the Vendor.

Other General Terms

Lava Rewards is only available in Malta and shall be governed by the laws of the country. Points can only be collected or redeemed locally. 

We may make changes to these Terms and also reserve the right to add or remove any of the Vendors.  We strive to keep our Members up to date with any changes and will give the Member as much notice as we reasonably can.

We may suspend or terminate the Website in the event of circumstances arising which in the Company’s opinion make it necessary for it to do so.  We will give as much notice as we reasonably can before we do so. If this happens all Accounts will be suspended or terminated. If we sell or transfer the Company and/or the Website to another company, we may transfer all of our rights and obligations under these Terms without any further consent and may disclose or transfer all information we hold about the Members to a prospective or actual new owner. Such a disclosure or transfer will not alter the rights of such Member in respect of the use that can be made of such information by such other company.

We may use third parties to facilitate one or more elements of the Website. We may also partner with new providers of goods or services which may form part of the Vendors. These third-party service providers/partners are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced related operation. 

These Terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. 

We may, on notifying the Member, immediately suspend or terminate their rights, refuse to award Points, withdraw Points, refuse the right to redeem Points collected and/or close any relevant Lava Rewards Account and Website Account, if they breach these Terms, if we reasonably believe that they have dealt with points in a manner not permitted by these Terms or any applicable Vendors’ terms and conditions, if there is any theft from or misconduct in connection with us or one of the Vendors’, if they supply false or misleading information to us or if they are abusive or offensive to any member of our staff.
